How We Charge — Complete Transparency
Both Azimi Law and Naimark Law Firm handle personal injury matters on a contingency fee basis, as permitted under Ontario Regulation 195/04 of the Solicitors Act and the Law Society of Ontario's rules governing fees.
What "contingency fee" means: Our legal fee is a percentage of the amount we recover for you. If there is no recovery, you owe nothing for legal fees. Our fee is only earned when we win for you.
Disbursements
Disbursements are the out-of-pocket expenses incurred in advancing your case — medical records, expert reports, court filing fees, and similar costs. Both firms fund disbursements on behalf of clients throughout the case. These disbursements are reimbursed from the proceeds of recovery. Specific terms are disclosed in the written retainer agreement.
Maximum Fee Percentage
The maximum contingency fee percentage charged by each firm is disclosed in the written retainer agreement presented to you before any solicitor-client relationship is established. You have the right to independent legal advice before signing any retainer agreement. You have the right to negotiate the fee.
Your Rights Before Signing
Before signing a retainer agreement, you have the right to: review the agreement carefully; seek independent legal advice; negotiate the fee and disbursement terms; and decline to proceed. You also have the right to terminate the retainer at any time, subject to any fee entitlement for work already performed.
No Upfront Financial Barrier
The contingency fee model is specifically designed to ensure that injured people are not denied access to experienced legal representation because of financial constraints.
